Rechtsstaatliche Prinzipien müssen eingehalten werden
Wien, 29.

GENEVA – 29 April 2014 – UN High Commissioner for Human Rights Navi Pillay on Tuesday strongly condemned the shocking imposition of the death penalty on 683 individuals in Egypt yesterday after mass trials that she said clearly breached international human rights law.
April 29th, 2014 | Tags: Al-Minya, Criminal Court, Death Penalty, egypt, Navi Pillay, Outrageous, Sixth Chamber | Category: Al-Minya, Alexandria, Cairo,Conflict, Corruption, Court, Egypt, Geneva, genocide, Middle East, Military Coup, Mohemmed Morsi
Mass Imposition Of Death Penalty in Egypt Outrageous
“It is outrageous that for the second time in two months, the Sixth Chamber of the Criminal Court in Al-Minya has imposed the death sentence on huge groups of defendants after perfunctory trials,” she said.
“In defiance of worldwide pleas for Egypt to respect its human rights obligations after 529 people were sentenced to death in March by the same court, hundreds now face a similar fate at the hands of a judicial system where international fair trial guarantees appear to be increasingly trampled upon.”
“It is high time that Egypt takes its human rights commitments seriously,” Pillay added, noting in particular that Egypt has ratified the International Covenant on Civil and Political Rights.
According to information received, the 683 defendants were charged with killing a policeman and breaking into the Edwa police station in Al-Minya on 14 August 2013, among other charges. As in the previous cases, the exact charges against each defendant are not clear, given that they were not individually read out in court.
“The presumption of innocence is fundamental to the protection of human rights in a criminal trial,” Pillay said.
“It imposes on the prosecution the burden of proving the charge against each accused and it guarantees that no guilt can be presumed until the charge against him or her has been proved beyond reasonable doubt.”
“Instead of imposing death sentences wholesale, courts must ensure that accused individuals enjoy fair trials, including the benefit of doubt,” Pillay stressed.
Of the 529 people who were sentenced to death by the Sixth Chamber of the Criminal Court in Al-Minya on 24 March for killing a policeman and on various other charges, 37 had their sentences upheld by the court yesterday, while others reportedly received reduced sentences of 25 years, in itself excessive, and were fined EGP 20,000.
“The death penalty can only be applied for the most serious crimes and after the most stringent trial safeguards,” the High Commissioner said. “This has clearly not been the case in these two trials before the Al-Minya criminal court. A mass trial of hundreds of people, rife with procedural irregularities is simply not good enough for imposition of the death

Egypt: Shocking Death Sentences Follow Sham Trial
A day after more than 500 supporters of ousted President Mohammed Morsi were sentenced to death, and two days after Barak Obama’s administration has approved the shipment of Apache attack helicopters to the military junta that rules Egypt, an Egyptian court has opened another mass trial and 683 more Brotherhood supporters were sentenced to death among them Mohammed Badie, the Muslim Brotherhood.
Minya, Egypt – Agencies – Egypt has opened another mass trial of suspects with 683 defendants facing charges of murder and sabotage, including the Muslim Brotherhood’s top leader.
The defendants sentenced were accused of involvement in the murder and attempted murder of policemen in the southern Minya province last August.
A final capital punishment ruling was also handed down for 37 others, part of a judgment on 529 Muslim Brotherhood supporters who were recommended for a death sentence last month.
The remaining 492 death sentences have now been commuted to life in prison.
Seeking the death penalty for Mohammed Badie, the Brotherhood’s general guide, is certain to raise tension in Egypt, which has been gripped by turmoil since the army removed the Brotherhood from power last year.
Proceedings were held in the southern city of Minya, where just the day before the same court handed down death sentences to 529 supporters of ousted President Mohammed Morsi over a deadly attack on a police station. That verdict followed a rushed, two-day trial that drew wide public and international criticism.
Only 60 of the 683 defendants were in the dock on Tuesday. The rest are being tried in absentia. The Brotherhood’s spiritual guide did not appear in court, with authorities citing security reasons.
On April 23 2014, Obama’s administration has approved the shipment of Apache attack helicopters to the military junta that rules Egypt. The decision was communicated to the military regime April 22 by defense secretary Chuck Hagel in a phone call to the Egyptian minister of defense, General Sedki Sobhy.
Hagel also told his Egyptian counterpart that US Secretary of State John Kerry will soon certify to Congress that “Egypt is sustaining the strategic relationship and is meeting its obligations under the 1979 Egypt-Israel Peace Treaty.” These certifications are required under US law to permit the continuation of US military aid.The ten Apache helicopters are “in support of Egypt’s counterterrorism operations in the Sinai,” according to a Pentagon press release, but there is no restriction on their use once the weapons are in Egyptian hands. The murderous gunships can be redeployed from strafing restive Bedouin tribesmen along the border with Israel to massacring demonstrators in cities like Cairo, Alexandria and Suez. The US will continue to withhold certain weapons, including F-16 fighter jets, M-1 tanks and Harpoon missiles, whose shipment has been suspended since the July 2013 coup that overthrew the elected president of Egypt, Mohammed Mursi of the Muslim Brotherhood.
Death Sentences Breach International Law
Earlier, the UN human rights commissioner has condemned an Egyptian court’s decision to sentence to death 528 supporters of ousted President Mohammed Morsi.
A spokesman for Navi Pillay said the “cursory mass trial” was “rife with procedural irregularities” and breached international human rights law.
On March 22, 2014, the criminal court in Minya, Egypt sentenced 529 people to death. It was the largest mass death sentence in recent years anywhere, in a trial lacking basic due process protections.
The vast majority of defendants were tried in absentia, took place in under an hour. The prosecution did not put forward evidence implicating any individual defendant, even though it had compiled significant evidence during its investigations and the court prevented defense lawyers from presenting their case or calling witnesses, three of the defense lawyers told Human Rights Watch. A second summary session was held two days later solely to announce the verdict. It’s shocking even amid Egypt’s deep political repression that a court has sentenced 529 people to death without giving them any meaningful opportunity to defend themselves. The Minya court failed to carry out its most fundamental duty to assess the individual guilt of each defendant, violating the most basic fair trial right. These death sentences should be immediately quashed.Human Rights Watch.

Ms. Saeed stated that the PA transferred two months’ pension after the death of her mother from the Palestinian Authority after her death. Saeed also said that her mother had suffered many troubles in recent years and before her death due to the constant delays on part of the PA in the payment of her pension.
Ms. Saeed also denied that her mother Dr. Mahran had worked for any intelligence services, saying instead that her mother had been an academic and a professor. According to Saeed, she finished her studies at University of Alexandria in Egypt, where she got a master’s degree and a doctorate, and later worked as a professor at the same university. According to her, the University of Alexandria allowed her mother to work at the PA with the late President Yasser Arafat, where she she received a position as a cultural advisor to Arafat.
Ms. Saeed stated that her mother “held sacred” the late Palestinian President Arafat and that she “worshiped him like a God”. According to Saeed, her mother wrote a book titled “Abu Ammar the Unbreakable” (Arabic: أبو عمار الرقم الصعب). She added that her mother had already worked very hard for the sake of Palestine and the Palestinians before her meeting with Arafat. Her articles in support of the Palestinian cause were published in the Kuwaiti newspaper Al-Qabas and in Al-Sharq Al-Awsat, which is published through the Middle East.
Ms. Saeed also stated that she and all her brothers loved President Arafat and they had been “like a family”. Ms. Saeed considers the late President Arafat as more than a father, and according to her, to this day she reads the Al-Fatihah prayer from the Holy Quran in memory of the late the President Arafat before going to sleep. Ms. Saeed kindly sent me a family picture of her mother, herself, brother and sons with the late President Arafat. This historic photo is published here as it shows a rare glimpse into the private life of the President and the team who worked with him. I wish to thank Ms. Saeed and her family for their kindness and for allowing that this private information becomes published.

12 Soldiers Killed In Car Bomb Attack in Egypt
According to reports a suicide bomber rammed an explosive-laden vehicle into one of two busses carrying off-duty soldiers between Rafah and el-Arish, the regional capital of North Sinai, where security forces are battling Islamists.
The blast was one of the deadliest attacks in the Sinai since al Qaeda-inspired militants began stepping up assaults following the army’s ousting of Islamist President Mohamed Morsi.
Although no group has claimed responsibility, suicide car bombings are a signature method used by militant groups linked to or inspired by al Qaeda.
Sky News’ Middle East producer Tom Rayner said: “This area has seen unrest for some time but that unrest, lawlessness and insurgency the army are trying to fight has increased in intensity since the coup against former President Morsi in July.
“What we’ve seen since then is an increase in attacks against soldiers at checkpoints in the Sinai but also in Egypt itself here have been repeated attacks on army checkpoints.
“The anger is based around the fact they are trying to control this area where there are tunnels going into Gaza. This will be a serious omen for the Egyptian army in their attempts to control insurgency in the north of the Sinai.”
The attack came after one person was killed and dozens more injured during clashes between opponents and supporters of Egypt’s military-backed regime in Cairo’s Tahrir Square on Tuesday.
Police backed by armoured vehicles fired tear gas and shots to drive protesters out the square after they gathered to mark the anniversary of the 2011 demonstrations against the military which took power after Hosni Mubarak’s overthrow.
During those protests more than 40 protesters were killed during fighting with security forces which lasted several days.
During those protests more than 40 protesters were killed during fighting with security forces which lasted several days.
Tuesday’s rally was aimed against people the protesters felt had “betrayed” the revolution – Mubarak loyalists, the military council that ruled for 17 months after his fall, and the Islamist Muslim Brotherhood which won subsequent elections but was ousted by the military in July.
The military handed power to Islamist president Mr Morsi in June 2012, after he won the country’s first free election, but overthrew him a year later following mass protests demanding his resignation.
Some protesters threw rocks and fireworks but left the square shortly after the security forces moved in.
Security forces have killed hundreds of Muslim Brotherhood members since Mr Morsi was removed from power.
Thousands have been arrested and the group has been outlawed.
The new military-backed government of General Abdel Fatah al Sisi is pushing ahead with a transition plan aiming for new presidential and parliamentary elections early next year.

The entire Egyptian society was shocked and dismayed to see Al-Azhar University students were sentenced to prison terms of 17 years and a fine of 64 thousand each, (about $ 92400) because of a peaceful protest against the dictator leader of Al Azhar. The students were tried for allegedly trying to break into their own university. Meanwhile, those who kill or torture people or threaten the public with deadly weapons are not brought to trial or even jailed.

The Ugly Face of Egypt After The Military Coup
The undersigned organizations are strongly condemn the verdict by Al Gamaleya court of misdemeanor in case no. 7332/2013 on 12 November 2013 to sentence 12 students at El Azhar university to 17 years in prison and a bail of LE 6400 (US $9292) for non-implementation of the sentence.
The students had last been arrested during their demonstrations in front of the Azhar chiefdom on 30 October while protesting the arrest of a number of their colleagues and to express their opposition to the current authority, which they consider illegitimate. During their protest, members of Azhar security attacked the students with knives, arrested a number of them and held them inside the Azhar chiefdom premises before handing them over to the El Gamaleya police. The police documented the incident and summoned the prosecution, which then interrogated the students inside the police station.
The undersigned organizations recognize that the arrest of the students and putting them to trial is a violation of the right to demonstration and freedom of expression. The harsh sentences and conditioning their release with payment of such a high bail is a violation of the right to a fair trial. The undersigned organizations also reiterate that demonstration and expression of opinion through peaceful means is a human right, which Egyptian authorities must respect and protect and that the current political conflict in Egypt should not be used as a pretext to violate the right of any person to a fair trial.
Based on the above, the undersigned organizations believe that the respective court was at fault in its impartial implementation of the law and supporting the freedom of individuals. Aside from the accusations made by the prosecution against those students, whether true or false, the court has dealt with cruelty against the sentenced students, by punishing them for all charges raised by the public prosecution, despite all the charges being related to their arrest during their protest in front of Al Azhar chiefdom. This is considered a flagrant violation of the provisions of the Egyptian penal code which obliges criminal courts, in the case of indivisible, multiple crimes for the same purpose, to consider them all one crime and sentence the maximum penalty for those crimes.
Also, the court ordered the students to pay a bail of LE 64000 as a condition to stop the execution of the sentence and their release until the time of appeal, scheduled for 4 February 2014. Only one student could afford to pay this sum, while the rest of the students are still in detention until now. This very high sum for a bail and the remote date set for the appeal, according to which the students will remain in prison, indicates a tendency to harass those students, raising the possibility of a vengeful nature of the verdict, politically motivated and totally unrelated to the necessary respect and indiscriminate enforcement of justice.
The undersigned organizations believe that the security-driven policy towards the students’ movement at the current time threatens the independence of the university and the future of students’ rights and freedoms in Egypt, and raises concerns regarding the imposition of a tight security grip on campus life. During previous months, university administrations have abandoned reacting to student breaches though the specified disciplinary punitive measures and decided it was easier to leave the students prey to the authority of the police, with no regard to the impact this may have on their educational career or its impact on the escalation of acts of violence inside universities as well as deepen the rapidly increasing societal split in view of the ongoing political conflict.
Finally, the undersigned organizations call upon Al Azhar University to fully bear its responsibility and to immediately intervene and pay the necessary bails to release the students sentenced in the above mentioned case. Otherwise its position would indicate approval of the detention of those students until the time of their appeal, a matter of grave consequence to their academic career.
To learn more about the cause, kindly watch this video from the Association of Freedom of Thought and Expression’s (AFTE) press conference in solidarity with El Azhar students.

With the trial of former president Mohamed Morsi and major leaders of the Muslim Brotherhood under way on 4 November, Egyptian media workers are targets of attack. Freedom of information is threatened. Measures include military trials, arbitrary arrests, and abusive treatment in detention as Egyptian authorities maintains their campaign of repression.

This policy reflects a continuation of practices in effect since 2011. The successive governments in place since the fall of Hosni Mubarak – the Supreme Council of the armed forces, the Muslim Brotherhood, and today’s transition regime led by General Abdel Fattah al-Sisi – have all been determined to repress the media and control information.
“This new wave of threats to freedom of information in Egypt is especially disturbing,” Reporters Without Borders said. “Arbitrary arrests and hauling journalists before military courts constitute a danger to basic freedoms, as do prison terms, even if these are suspended. These practices must stop, and journalists still jailed because of their professional activities must be freed immediately and unconditionally.”
The repressive campaign against freedom of information violates decisions made by the committee in charge of drafting the new Egyptian constitution, notably a provision that would prohibit the detention of media professionals because of what they publish.
Hatem Abou el-Nour a journalist for Al-Watan, an Egyptian daily, was sentenced on 30 October to one year of prison by the Cairo military court. Arrested on 24 August, he is accused of impersonating a member of the military during telephone interviews with organizations not linked to the army in order to obtain information for his articles.
Freelance journalist Mohamed Sabry was sentenced on 3 November to a suspended term of six months in prison by a military court in Ismailia. He had been arrested on 4 January while taking photos in the Rafah military zone in northern Sinai. He was reporting on a military prohibition on land purchases in the border area. The trial of the journalist, who was free during the proceedings, was reported on extensively since shortly after his arrest.
Similarly, Ahmad Abu Deraa, a correspondent for the Egyptian daily Al-Masry Al-Youm,was sentenced on October to a suspended sentence of six months, and a fine of 200 Egyptian pounds ($30) by the Ismailia military court. The journalist, who had extensively covered army activity in Sinai, was arrested by security services on 4 September in the northern Sinai city of al-Arish and detained while awaiting sentencing.
Arrests and abusive treatment
Islam Fathi, a correspondent for the MBC Masr network was arrested in al-Minya, 245 km south of Cairo, on 21 October. The arrest followed an altercation with a police officer who prohibited him from filming, even though he had showed his journalist credential. Held in the city police station, he was tortured and beaten repeatedly by police, including officers. They accused him of supporting the Muslim Brotherhood. Fathi was freed the next day, after charges of attacking a police officer were dropped. His injuries required treatment at Minya University Hospital.
Mostafa Diab, correspondent for Al-Madar in Ismailia, was arrested on the afternoon of 27 October while covering a demonstration by students from Suez Canal University. He was released 48 hours later. He reportedly was detained for having filmed the demonstration without a permit.
Complaints against Bassem Youssef, and suspension of his program
Complaints were filed against comedian Bassem Youssef, host of “Al-Barnameg”, on the CBC network, following a broadcast on 26 October in which he was critical both of the Muslim Brotherhood as well as the new regime, and mocked the popular fervour in support of the army. Some viewers accused him of inciting chaos, threatening national security and insulting the army
Several days later, CBC distanced itself from the comedian’s point of view, then suspended the 1 November broadcast, just before the second episode of the season was due to air. The official justification was that he had broken some clauses of his contract.
“Complaints against comedian Bassem Youssef and the suspension of his show are especially regrettable,” Reporters Without Borders said. “Freedom of satirically critical expression, especially in the context of a humor program, must have a place in a country that aspires to democracy.”
